Bodycam video shows former MDPD officer stumbling and falling after alleged drunken crash involving patrol car – WSVN 7News | Miami News, Weather, Sports

SOUTHWEST MIAMI-DADE, FLA. (WSVN) – New video from a police officer’s body camera offers a new perspective on the arrest of a former Miami-Dade police officer.

Victor Montalvo, 43, was arrested on March 5 and accused of drawing his weapon after driving into a patrol car while under the influence of alcohol.

“Why did you draw your weapon?” an officer asked Montalvo.

“I don’t know,” Montalvo said.

The video was released by the Miami-Dade State Attorney's Office.

According to authorities, the marked police car blocked the inside lane to ensure the safety of road workers in the area.

A police report said Montalvo “unsteadily” got out of the SUV after the accident while the police officer checked on the workers in the marked vehicle.

“I want you to sit in the front,” said an officer.

In the video, Montalvo can be seen stumbling after the officer's request to stand up and comply. In another shot, he nearly falls over as he tries to sit on the curb.

“Secure that. Secure that, just stand there, don't stand there, I got you,” an officer said.

The video shows the damage to the police car caused by the accident up close.

According to investigators, the incident occurred early in the morning of March 5, when Montalvo was on duty.

The accused officer was in an unmarked black Ford Explorer when he rammed the occupied marked police car.

The police report states that at some point after the accident, Montalvo was “lying on his stomach in the street.”

The officer then reportedly saw Montalvo reach forward to his waistband and pull out a semi-automatic weapon, but quickly dropped the weapon after the officer loudly ordered him to drop the weapon.

According to the police report, the officer “smelled the odor of an alcoholic beverage on the defendant's breath, saw his watery eyes, and heard his slurred speech.”

Although police informed him of the consequences of refusing to take a breathalyzer test, Montalvo refused to take one.

Montalvo is expected back in court on June 18.

Miami-Dade police said Montalvo remains on leave with pay.
